What is the Telephone Consumer Protection Act?

Passed by the United States Congress in 1991, the Telephone Consumer Protection Act (TCPA) is an amendment to the Communications Act of 1934 that prohibits automated telephone solicitations and the use of automated telephone equipment.

The above stipulation involves restrictions using prerecorded voices, automated text messages, automated fax messages and auto dialers among other provisions that require identification and contact information from the entity sending the messages.

TCPA legislation has been amended numerous times throughout its existence and continues to be an invaluable legal precedent in the fight against unwarranted spam for consumers and businesses alike.  But even with such a platform the Federal Trade Commission states that robocalls have become more prevalent than ever.  With billions of automated robocalls every single year, there are countless companies abusing the rights of individuals all over the nation.
